Skyllamas Podcast Studio Package Purchase Terms and Conditions

Thank you for choosing a package from Skyllamas Podcast Studio. By purchasing our package, you agree to the following terms and conditions:

 

  1. Services & Scheduling:

 

– Skyllamas Podcast Studio agrees to provide the podcast production services as outlined in the package you’ve selected.

-Recording spots must be scheduled and purchased in advance.

-Each recording slot is for up to an hour, with a 15-minute before and after buffer for setup and wrap-up.

-Unused time during your session does not rollover to another one.

-The provided space accommodates setups for up to four individuals.

-The green room is available free of charge during your 15-minute buffer time for touch-ups. If a makeup artist is utilized, or you need a space for your guests for an extended period of time, the green room (aka Hollywood Room) rental fee is $50 per hour plus tax.

 

  1. Recording Time and Extensions:

 

-The studio clock is utilized by the host to keep track of the recording duration. A signal (flash) will be given when the recording reaches 60 minutes.

-Extension requests should be made upon arrival. Additional time is subject to availability and will be pro-rated based on your current package.

-Charges for extra studio time and post-production work will be billed after the session.

 

  1. Financial Terms:

 

-To cancel or reschedule, notify us 24 hours in advance. Late cancellations will incur a 100% session rate fee. Cancellations Fees paid for canceled sessions 24h or earlier will be applied to future bookings.

-Exceptions for emergencies may be granted at our discretion.

-Payment details, including additional fees, are available on www.skyllamaspodcast.com.

-Packages expire one year from purchase. Refunds are available within 30 days of purchase for unused sessions.

-Clients are responsible for any damages caused during their sessions. This includes damages resulting from the misuse of equipment, furnishings, or any studio property, whether due to negligence or misconduct, including excessive alcohol consumption.

-We provide necessary equipment and support. Misuse or damage will incur charges.

 

  1. Content Management and Intellectual Property:

 

-You, as our client, retain intellectual property rights in the finalized and edited podcasts produced and delivered by Skyllamas Podcast Studio, including all content within the provided delivery folder handed over after completion of our services.

-Skyllamas Podcast Studio reserves the right to retain ownership of all raw material generated during recording sessions, encompassing unedited audio and video recordings, rough cuts, and any other material captured during the recording process prior to editing.

-Skyllamas Podcast Studio commits to storing the recorded materials for a minimum period of one year from the date of recording.

-During this period, you may request a copy of these materials in case of loss or for any other purpose.

-After the one-year period, the availability of these materials is not guaranteed, unless a different arrangement is specified in writing.

-Clients are encouraged to maintain their own backups of delivered content.

-Responsibility for securing appropriate rights or licenses for any third-party materials incorporated into the podcast rests with you. Ownership of these materials remains with their respective original owners.

-While we retain ownership of the raw materials, their use is limited to internal purposes, such as quality control, training, or archival purposes, unless otherwise agreed upon in writing.

-You are responsible for ensuring all content, including third-party materials in your podcast, complies with relevant copyright laws and does not infringe upon others’ intellectual property rights.

-Compliance with Laws and Studio Policies: When Skyllamas Podcast Studio is engaged in editing and manipulating podcast episodes, it is crucial that the content provided by the client complies with all applicable laws, regulations, and studio policies.

-Studio’s Right to Refuse Release: If the content provided by the client or created during the session is found to be in violation of any laws or studio policies, Skyllamas Podcast Studio reserves the right to refuse the release of the recorded materials.

-No Refunds for Non-Compliant Content: In cases where the recorded materials are withheld due to non-compliance, the client will not be eligible for a refund for the session.

-Client’s Responsibility for Content: The client bears full responsibility for ensuring that their content is lawful and adheres to our guidelines.

-Consultation and Review: Clients are encouraged to consult with Skyllamas Podcast Studio prior to the session if they have any doubts about the compliance of their content. The studio may offer preliminary review services to assist in ensuring content adherence to legal and policy standards.







  1. Studio and Client Responsibilities:

 

-We encourage clients to arrive on time for their sessions. Please note that late arrival does not result in an extension of the scheduled session time.

-While moderate drinking during sessions may be permitted, clients and their guests are strictly prohibited from getting drunk on the studio premises.

-Skyllamas Podcast Studio does not provide alcohol for recording sessions. Any alcohol consumed on the premises must be brought by the clients and consumed responsibly.

-Smoking is strictly prohibited within the studio premises.

-Clients are fully responsible for the behavior and conduct of their guests while on the premises of Skyllamas Podcast Studio.

-Guests are expected to maintain a respectful, professional demeanor conducive to a productive recording environment.

-Disruptive behavior is strictly prohibited. This includes excessive noise, harassment, and excessive intoxication leading to violence or threatening behavior.

-Should any guest display unacceptable behavior, Skyllamas Podcast Studio reserves the right to terminate the recording session immediately, require the offending individual(s) to leave the premises, and deny future studio access to the client and/or involved guests.

-If a session is terminated due to guest misconduct, the client remains liable for the full cost of the booked session. No reimbursement will be provided for time lost due to such incidents.

– Clients and guests are encouraged to report any concerns or incidents to studio staff immediately.

 

  1. Promotional Use and Rights:

 

-Skyllamas Podcast Studio reserves the right to use portions of the content produced by clients in our studio for promotional purposes.

-The studio may use audio clips, video snippets, photographs taken during sessions, and excerpts from recorded content.

-Clients have the right to opt-out of this promotional use.

-When using client content for promotional purposes, Skyllamas Podcast Studio will ensure that such use does not misrepresent, defame, or violate the privacy rights of the client or any individuals featured in the content.

-The content may be used for promotional purposes as long as it remains relevant to our services, unless otherwise requested by the client.

-Clients acknowledge that they will not receive any compensation for the use of their content in the studio’s promotional materials.

-Skyllamas Podcast Studio reserves the right to amend these terms of promotional use, and any such amendments will be communicated to clients in a timely manner.





  1. Legal and Compliance:

 

-We commit to restricting the use and disclosure of your confidential information to the purpose of our agreement.

-Services will be provided professionally and in compliance with applicable laws.

-Clients are solely responsible for all content produced, recorded, or broadcast during their podcast sessions at Skyllamas Podcast Studio.

-It is the client’s responsibility to obtain all necessary legal releases or consents from guests or contributors participating in the recording.

-The client agrees to indemnify, defend, and hold harmless Skyllamas Podcast Studio, its owners, employees, and agents from any and all claims, liabilities, damages, and expenses.

-Clients are expected to be fully aware of and comply with all laws and regulations relevant to their content.

-Skyllamas Podcast Studio is not responsible for monitoring the content created by clients and does not accept liability for any content that clients produce or broadcast.

 

  1. Operational Policies:

 

-Podcast production time varies, with delivery taking a minimum of 1 to 3 weeks, depending on the studio workload.

-Music will adhere to terms set by third-party licensing platforms used for production.

-For in-house music creation, additional restrictions may apply.

-We reserve the right to modify these terms without prior notice. Clients are encouraged to review them periodically.

-We are not liable for non-performance due to uncontrollable events.

-Disputes will be resolved through mediation or arbitration.

-Communications should be directed to specific channels.

-We are committed to maintaining a safe, professional, and welcoming environment. We reserve the right to review and approve all guests.

-Guests must be well-maintained and presentable. Clients are responsible for informing their guests of these standards.

-Clients booking multiple slots in a day will be charged for all, regardless of actual use.

 

  1. Policies for Minors:

 

Parental Consent: Minors (individuals under the age of 18) are welcome to use Skyllamas Podcast Studio services, but they must have consent from a parent or legal guardian. Written consent must be provided prior to the recording session.

Accompaniment by Adult: Minors should be accompanied by an adult during their time in the studio, unless prior arrangements have been made with Skyllamas Podcast Studio management.

Content Restrictions for Minors: Content involving minors must be appropriate and adhere to all legal standards. It is the responsibility of the client to ensure that the content of the podcast does not violate any laws or regulations related to the protection of minors.

Safety and Comfort: The safety and comfort of minor guests in our studio are of utmost importance. We maintain a safe and professional environment and expect all clients and guests to contribute to this atmosphere.

Data Privacy for Minors: Extra precautions will be taken to protect the personal data and privacy of minors. Information pertaining to minors will only be used for the purpose of the podcast recording and will not be shared without explicit consent from a parent or legal guardian.

Responsibility of Client: The client bringing in the minor is responsible for their well-being and behavior. Any misconduct or safety concerns should be immediately addressed to studio staff.

 

  1. Recording Approval and Release for Participants:

 

Mandatory Consent for Recording: All guests, co-hosts, and participants involved in a recording session at Skyllamas Podcast Studio must sign a Recording Approval Release form. This form is a mandatory agreement that grants the studio permission to capture their voice, image, and any other visuals during the session.

Purpose of Consent: The consent ensures compliance with legal standards regarding privacy and recording. It allows us to use the recorded material as part of the podcast production, in adherence to the agreed-upon terms.

Procedure for Obtaining Consent: Prior to the commencement of any recording session, all participants are required to complete and sign the Recording Approval Release form. Our staff will provide the forms and assist with any questions.

Use of Recorded Material: The consent obtained will cover the use of the participants’ voice and image in the podcast and any related promotional or marketing materials, unless otherwise specified in the form.

Protection of Participant Rights: Skyllamas Podcast Studio is committed to respecting and protecting the rights of all recording session participants. Any use of the recorded material will be done in a manner that respects the dignity and privacy of the individuals involved.

Availability of Release Forms: Release forms will be available at the studio and can also be provided electronically upon request. For group recordings, it is the responsibility of the booking client to ensure that all participants are aware of and have signed the release forms prior to recording.

  1. Technology and Equipment Failures

 

At Skyllamas Podcast Studio, we prioritize a high-quality recording experience. However, we acknowledge that unforeseen technical issues can occur. Here’s our approach:

 

Immediate Resolution and Plan B: In the event of equipment failure or technical issues, our team will immediately attempt to resolve the problem. We have backup equipment and trained technicians on standby. If needed, we will switch to alternative equipment or relocate the session within our studio.

 

Rescheduling at No Additional Cost: If the issue is not resolvable in a timely manner, we will offer to reschedule your session at no extra cost, based on the next available slot that suits you.

 

Case-by-Case Goodwill Gestures: Recognizing the inconvenience caused by technical disruptions, we will consider goodwill gestures, such as discounts or session extensions, on a case-by-case basis. Our aim is to ensure client satisfaction while being fair and reasonable to both parties.

 

Communication is Key: We believe in transparency. Our team will keep you informed about any issues, their expected resolution, and any potential impact on your session.

 

Client’s Equipment Responsibility: Please ensure any personal equipment brought in is in good working order. We are not responsible for issues arising from external equipment malfunctions.

 

Feedback for Improvement: We welcome and value your feedback, especially regarding our handling of technical issues. It aids in our continuous efforts to enhance our studio’s technology and client experience.

 

  1. CCTV Surveillance Policy:

 

System and Coverage: Skyllamas Podcast Studio is equipped with a CCTV security camera system. This system is used for video recording only in common areas of the studio, excluding private areas such as changing rooms.

 

Compliance with Privacy Laws: Our CCTV system operates in compliance with New Jersey’s privacy statutes. We ensure that cameras are carefully positioned to respect the privacy rights of individuals, focusing only on common areas where there is no reasonable expectation of privacy.

 

Notification of Video Recording: Clear signage is posted at the studio entrance and other strategic locations, notifying all entrants that CCTV video recording is in operation. By entering the studio, individuals acknowledge and consent to this video recording.

 

Purpose of Recording: The CCTV system is intended for the security and safety of clients, staff, and property. It assists in monitoring studio activities, deterring unauthorized activities, and ensuring compliance with studio policies.

 

Data Security and Footage Usage: Video footage is managed in accordance with applicable data protection and privacy laws. Access to this footage is strictly limited to authorized personnel and is used solely for the purposes of security and operational monitoring.

 

Disclosure of Footage: Footage from the CCTV system may be disclosed to law enforcement or other authorities only if required by law or for the purposes of a criminal investigation.

 

By utilizing the facilities of Skyllamas Podcast Studio, clients and visitors agree to the terms of this CCTV surveillance policy.
